Before you train
Participant agreement and risk warning
Nexus Performance Lab · Perth, Western Australia
This is a practical template for football coaching, testing, and strength work. It is not legal advice. Have a Western Australian solicitor review it before you rely on it, and match it to your public liability insurance. It does not exclude liability for reckless conduct.
1. Who this is between
This agreement is between Nexus Performance Lab (“we”, “us”), operating in Perth, Western Australia, and the participant named at the end (“you”). If the participant is under 18, it is also with their parent or legal guardian.
Legal name: ________________________________ ABN: ____________________

2. What the sessions are
Sessions may include Performance screening and fitness testing, strength and conditioning, sprinting, change of direction, jumping and landing, movement coaching, and football technical or small-group work, indoors or outdoors, at a ground, park, gym, or other venue we nominate.
This is physical coaching. It is not medical, physiotherapy, or emergency care, and it is not a guarantee of selection, fitness, or performance.
3. Risk warning
Football, speed work, and strength training have obvious risks. Even with a proper warm-up and supervision, you can be injured. Risks include:
- Muscle strains, joint sprains, bruises, cuts, blisters, and skin abrasions.
- Fractures, dislocations, tendon or ligament injury, and back or neck injury.
- Concussion and head contact from a ball, the ground, or another person.
- Dehydration, heat illness, fainting, and, rarely, a cardiac event.
- Trips and falls from uneven ground, wet surfaces, equipment, or other people.
- Aggravation of an injury, illness, or condition you already have.
These risks can cause pain, time off school, work, or sport, and in rare cases permanent disability or death. By signing, you acknowledge that you understand these risks and you choose to take part anyway.
4. Your health
You confirm that, to the best of your knowledge:
- You are well enough to do the session you have booked.
- You have told us about any injury, illness, surgery, concussion history, heart condition, asthma, diabetes, allergy, or medication that could affect training.
- You will tell us straight away if something hurts in a new or sharp way, if you feel dizzy or unwell, or if you hit your head.
We may stop or change a session if we think it is unsafe. You must stop if we ask you to. If you are returning from injury, you should have clearance from your doctor or physio where that is appropriate. We can ask for it.
5. How you take part
- Arrive in suitable footwear and clothing, and bring water.
- Follow instructions on warm-up, load, and how a drill is run.
- Do not attend under the influence of alcohol or drugs that impair training.
- Treat other participants, venues, and equipment with care.
- Tell us if you are under 18, or if you are booking for someone who is.
6. What this agreement does, and does not, do
To the extent the law allows for recreational services in Western Australia, you agree that we are not liable for injury, loss, or damage arising from the inherent risks of the sessions, or from a risk we have warned you about, where that injury is not caused by our reckless conduct.
Nothing here excludes a right that cannot legally be excluded. It does not exclude liability for reckless conduct, and it does not exclude guarantees under the Australian Consumer Law except to the extent section 139A of the Competition and Consumer Act 2010 (Cth) and Western Australian law allow a limit for death or personal injury in the supply of recreational services.
You are responsible for travel to and from the session, and for items you bring.
7. Under 18
Players are taken from 15. If the participant is under 18, a parent or legal guardian must sign this agreement and complete the player questionnaire. They confirm they have read this agreement, explained the risks in an age-appropriate way, and consent to the child taking part. If the player is under 16, a parent stays for the session. We may refuse a minor if a parent or guardian has not signed.
8. Photos and video (optional)
This is separate from the risk warning. Tick one:
☐ You may use photos or short video of me / my child on the website and social media.
☐ Do not use photos or video of me / my child publicly.
You can change this later by emailing info@nexusperth.com. Faces of other people’s children will not be posted without their consent.
9. Privacy
The booking form and the player questionnaire ask for the same things: name, age, contact, position, club, goal, and injury or health detail. You complete both before payment. The agreement is the consent for the session. The questionnaire is the information the session is built from.
Injury, concussion, medication, and similar answers are health information. We use them only to decide if a session is safe and to plan the work. We do not sell them, and we do not put them on social media. Card payment is taken by Stripe and does not include those answers.
The answers are stored with the booking, visible only in the coach studio. You can ask for a copy or a correction by emailing info@nexusperth.com. We keep them while you are training with us, and for as long as we need them if there is a dispute or an insurance question, then we delete them.
This is not a privacy-law opinion. Nexus Performance Lab should have this notice checked against the Australian Privacy Principles, because health information is involved even if turnover is under $3 million.
10. Law
This agreement is governed by the laws of Western Australia. If a clause is unenforceable, the rest still applies.
11. Sign
Type your name. That is your signature. It is stored with the booking, and you get a copy before you pay.
Template only. Not a substitute for advice from a WA solicitor or your insurer. Use your browser’s print option to save a PDF. Review before first use, and again if the sessions change.
